For Attorneys: Referrals, Second Opinions and Co-Counsel
Pelta Law accepts felony referrals, second opinions, trial consulting, co-counsel work and conflict referrals from attorneys across the nine Bay Area counties. Marc Pelta is a former Del Norte County deputy district attorney in private criminal defense practice since 2008.
Referring a felony matter
Contact Marc about the county, the charge, the current stage and any approaching court date. A conflict check comes before case facts or documents are shared. Discuss the scope of the referral and any communication with referring counsel before representation begins.
The practice covers serious and violent felony charges, weapons allegations, drug offenses and cases involving prior strikes. The felony defense page describes the practice areas.
Second opinions
A client or counsel may want another assessment of the charges, a plea offer or trial preparation. Contact Marc to discuss the question and the scope of a possible review. Sharing information with the referring lawyer depends on the client's consent and the circumstances.
A request for a second opinion does not extend a court deadline or keep an offer open. Existing counsel remains responsible for the case unless the representation changes.
Trial consulting and co-counsel
Discuss a defined role with Marc, such as reviewing a charge, preparing a motion or participating as co-counsel. Availability, responsibilities and terms are agreed for the particular matter.
Conflict referrals
A referring firm's conflict does not establish that Pelta Law can accept a matter. Marc conducts a separate conflict check before receiving substantive information. Begin with contact details and ask how to provide the names needed for that check.
Fee divisions
Discuss any proposed lawyer-to-lawyer fee division directly with Marc. California Rule of Professional Conduct 1.5.1 requires a written agreement between the lawyers, the client's written consent after written disclosure, and a total fee not increased solely because of the division.
